1. Agreement to These Terms
By accessing, purchasing, or using any services provided by Web Guidance, you agree to be bound by these Terms and Conditions.
Acceptance of these Terms occurs when you confirm agreement during checkout (including by ticking the acceptance box on a Stripe payment link), make a payment, or confirm agreement in writing via email or message. This acceptance forms a legally binding agreement between you and Web Guidance.
If you do not agree to these Terms, you must not proceed with payment or engage our services.
Web Guidance reserves the right to update these Terms and Conditions at any time. Updated terms will apply to new projects and, where applicable, ongoing services.
2. Services Provided
Web Guidance provides website guidance, website development, optimisation, and digital system setup services. Services may include, but are not limited to:
Website planning, design, and build
WordPress and WooCommerce setup
Website optimisation and performance improvements
Form, consultation, and workflow systems
Payment gateway setup support
Automation and operational system guidance
Hosting, security, backups, and maintenance (where agreed)
Ongoing support and advisory services
Specific services, deliverables, timelines, and costs are agreed per project and confirmed in writing via email, onboarding documentation, or messages prior to work commencing.
3. Project Scope and Delivery
All work is delivered based on the agreed project scope confirmed before work begins. This scope may be outlined in written communication such as email, onboarding forms, or messages.
Web Guidance is responsible for delivering the agreed services and outcomes only. We do not guarantee business performance, revenue, regulatory approvals, or specific commercial results.
Project timelines are estimates and depend on timely client responses, feedback, approvals, and access to required systems. Delays caused by missing information, late responses, or lack of access may result in revised timelines.
Important: We retain ownership of all work until full payment has been received.
4. Client Responsibilities
To ensure successful delivery, clients agree to:
Provide accurate, complete, and timely information
Supply required access to hosting, domains, email, and third-party services
Purchase and maintain required third-party services and licences
Ensure content and materials provided are legally owned or licensed
Review and approve work within reasonable timeframes
Ensure compliance with any industry regulations relevant to their business
Failure to meet these responsibilities may delay delivery or affect website functionality.
5. Payments, Deposits, and Refunds
Project fees cover Web Guidance’s time, expertise, and delivery only.
A deposit is required before any work begins. Once work has started, all deposits and payments are non-refundable, as time and resources are immediately allocated to the project.
Remaining balances are due as agreed, typically prior to or at project launch. Failure to make payment may result in work being paused, delayed, or access to services being restricted.
All payments are processed securely via Stripe. Stripe receipts act as proof of payment and acceptance of these Terms and Conditions.
6. Additional and Third-Party Costs
Unless explicitly stated otherwise, the following are not included in project fees and must be paid directly by the client:
Domain names
Hosting services
Email services (e.g. Google Workspace)
Third-party plugins, licences, or software
Payment processor fees and transaction charges
These costs are standard operating expenses and remain the client’s responsibility. Web Guidance does not add markups to third-party services.
7. Third-Party Services
Web Guidance may assist with the setup, configuration, or guidance of third-party services. However:
Third-party services are owned and controlled by the client
Web Guidance is not responsible for third-party outages, changes, failures, or pricing updates
Ongoing costs and compliance remain the client’s responsibility
Examples include hosting providers, plugins, payment gateways, email services, and delivery services.
8. Hosting, Security, and Maintenance
Where hosting or maintenance services are provided or managed by Web Guidance:
Reasonable measures are taken to ensure uptime, backups, and basic security
No website or system can be guaranteed to be fully secure
Web Guidance is not liable for losses caused by hosting provider failures, attacks, or third-party issues
Clients may request to transfer their website to their own hosting provider at any time. A £150 hosting migration and handover fee applies.
Hosting and maintenance services may be suspended for non-payment with reasonable notice.
9. Revisions and Additional Work
Projects include only the work outlined in the agreed scope.
Requests for additional features, changes, or functionality outside the agreed scope may:
Require a revised quote
Be billed separately
Extend project timelines
No additional work is undertaken without client approval.
10. Intellectual Property
Upon full payment:
Clients receive ownership of the final agreed website deliverables
Web Guidance retains ownership of pre-existing tools, frameworks, methods, and reusable code
Third-party materials remain subject to their respective licences
Web Guidance reserves the right to display completed work in portfolios and promotional materials unless otherwise agreed in writing.
11. Liability and Disclaimers
Web Guidance provides services on a best-efforts basis.
We do not guarantee:
Business performance or profitability
Search engine rankings or traffic levels
Platform approvals or regulatory outcomes
Web Guidance’s total liability is limited to the fees paid for the specific service provided. We are not liable for losses caused by third-party systems, client actions, misuse of the website, or events outside our control.
12. Confidentiality
Both parties agree to keep confidential any non-public business, technical, or operational information shared during the course of the project, except where disclosure is required by law.
13. Termination
Either party may terminate an agreement with written notice.
If termination occurs:
All work completed to date remains payable
Deposits and payments already made remain non-refundable
Access to services or deliverables may be withheld until outstanding balances are settled
14. Privacy and Data Protection
Web Guidance complies with applicable data protection laws, including UK GDPR. Personal data is handled in accordance with our Privacy Policy, which forms part of these Terms.
15. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Acceptance
By making a payment, ticking the acceptance box at checkout, or continuing to engage Web Guidance services, you confirm that you have read, understood, and agreed to these Terms and Conditions in full.
